INDIAN PREFERENCE:
 Preference in filling vacancies is given to qualified Indian candidates in accordance with the Indian Preference Act of 1934 (Title 25, USC, Section 472). NOTE: If the position is filled at a lower grade level, subsequent promotion to the next grade level will be processed without further competition under the Merit Promotion Program at such time as performance and qualification requirements are met and classification review discloses the duties being performed properly warrant classification to the next higher grade level. 
SUMMARY OF DUTIES:  Incumbent plans and implements acquisition and disposal transactions and projects for trust and restricted property, ensuring the protection of trust assets and receipt of fair market value or agreed upon value.  Serve as an advocate in assisting the tribes and tribal members with respect to the conveyance of their real property holdings.  Complete the recommendation for approval/disapproval of the conveyance.  Ensure that approval/disapproval of the conveyance.  Ensure that approvals/disapprovals/awards are recorded in the appropriate system of record.  Ensure that beneficiaries and other interest parties are aware of the decision, appeal rights, etc.  Provides assistance in areas related to real estate services, and real estate technical personnel and reviews work in progress to provide advice on assignments, release of information, completeness of process, etc.  Researches, analyzes and reviews complex and conflicting problems and issues, and provides findings and recommendations on problems/issues. Provide technical assistance to tribal members who apply for the sale of land, patents in fee, exchanges, partitionments, removal of restrictions, and return to trust status of fee lands. Authorize appropriate and accurate distribution of funds.  Consult with land owners and other interested parties about the conveyance process and other needs and documentation.  Additional tasks may include management tasks appropriate to the role and location, including contributions in the following areas; managing performance, managing relationships, supervising others, budgeting/reporting/analysis, and creating an environment of excellence.


Qualifications and Evaluations

QUALIFICATIONS REQUIRED:

EXPERIENCE AND EDUCATION REQUIREMENTS: (OPM Operating Manual, Qualification Standards for Administrative and Management Positions, GS-1170).

GS-11: 1 year of specialized experience equivalent to the GS-9 grade level OR Ph.D. or equivalent doctoral degree or 3 full years of progressively higher level graduate education leading to such a degree or LL.M., if related.

GS-09: 1 year of specialized experience equivalent to the GS-7 grade level OR master’s or equivalent graduate degree or 2 full years of progressively higher level graduate education leading to such a degree or LL.B. or J.D., if related.

GS-07: 1 year of specialized experience equivalent to the GS-5 grade level OR 1 full year of graduate level education or superior academic achievement.

SPECIALIZED EXPERIENCE: Experience that equipped the applicant with the particular knowledge, skills, and abilities (KSA’s) to perform successfully the duties of the position, and is typically in or related to the position to be filled.  Examples of specialized experience may include work involving providing oversight to management of trust and restricted property; performing on-site inspections for compliance; recommending corrective action or changes needed; analyzing transactions including applications, land descriptions, appraisals, NEPA, TSR, and other clearances, to ensure compliance; consulting with beneficiaries, lessees, land owners and other interested parties about the contracting process, options, and other needs and documentation. SUPERIOR ACADEMIC ACHIEVEMENT:  Superior Academic Achievement (S.A.A.) must have been gained in a curriculum that is qualifying for the position to be filled.  S.A.A. is based on (1) Class standing-applicants must be in the upper third of the graduating class, based on completed courses; or (2) Grade-Point Average-applicants must have a grade-point average of 3.0 or higher out of a possible 4.0 based on 4 years of education, or as computed based on courses completed during the final 2 years of the curriculum; or 3.5 or higher out of a possible 4.0 based on the average of the required courses completed in the major field completed during the final 2 years of the curriculum; or (3) Election to membership in a National Scholastic Honor Society – membership in a freshman honor society cannot be used to meet the requirements of this provision. 



SUITABILITY, CLEARANCE & REQUIREMENTS: A background security investigation will be required for all new hires. Appointment will be subject to the applicant’s successful completion of a background security investigation and favorable adjudication. Failure to successfully meet these requirements will be grounds for termination.
OTHER: Incumbent is required, as an incidental duty, to operate a government-owned or leased motor vehicle, in the performance of duties, therefore, a valid driver’s license is required. Incumbent must have a safe driving record within the three-year period immediately preceding submittal of GSA Form 3607 and be able to meet the safe driving requirements of the Bureau of Indian Affairs.

  • ABLILITY TO READ AND INTERPRET MAPS OF DEFINITE LOCATION, PLATS, SURVEYS, ALIQUOT PARTS, METES AND BOUNDS DESCRIPTIONS, ETC., AND A BASIC KNOWLEDGE OF CADASTRAL GEOGRAPHIC INFORMATION SYSTEMS, INDIAN TRUST LAND BOUNDARY DESCRIPTIONS AND OTHER ELECTRONIC DATA SYSTEMS.
  • ABILITY TO COMMUNICATE AND WORK APPROPRIATELY AND EFFECTIVELY WITH BENEFICARIES AND CLIENTS TO ASSESS THEIR NEEDS, PROVIDE ACCURATE INFORMATION OR ASSISTANCE AND ADDRESS PROBLEMS.
